Overview
We recognise there are some disputes that simply cannot be resolved other than through the Courts. However, most cases are suitable for Mediation or Alternative Dispute Resolution and the Courts encourage parties to consider Mediation.
We are great believers in Mediation as a method of resolving disputes and will encourage our clients to consider Mediation at all stages of the litigation process.
It is often said that a successful mediation is one with which both parties are unhappy. There is an element of truth in this, that said, we believe a dispute resolved at Mediation can achieve certainty for clients and a significant saving in costs.
We can advise you on the appropriate mediator and represent you at mediation.
We have acted in mediations concerning the following:
- Breach of Contract following the purchase of an aircraft;
- Challenge to the validity of a Will raising issues of Mental Capacity, Want of Knowledge and Undue Influence;
- Claim for Financial Provision from the Estate of a deceased person,
- Claim for the repayment of Business Rates paid in respect of non-domestic property (£0.5m);
- Complex claim against Financial Advisers arising out of the liquidation of Financial Advice business;
- Protracted Neighbour dispute.
